When Delta 9 first started appearing in smoke shops across the US, people were confused. Delta 9 THC is hemp-derived and has similar effects to THC from cannabis. Because Delta 9 is derived from hemp, it can be sold legally under federal law thanks to the 2018 Farm Bill, even in states that haven’t officially made cannabis legal yet.
How is Hemp-Derived THC Safe to Buy in the US?
The 2014 and 2018 Farm Bills were game changers for those in the hemp industry. Before, there was very little wiggle room, but with the passing of these bills, doors opened up for the future of hemp, those who farm it and those who enjoy using it.
The 2014 Farm Bill allowed very limited industrial hemp to be grown by state agriculture departments under a pilot program for educational purposes. They also established a definition for “industrial hemp” and set the THC limit at 0.3% on a dry weight basis. This was a huge step for the cannabis community, because before this bill, all hemp was considered a Schedule 1 drug by the FDA with serious legal consequences for growing, possession and selling.
While the 2014 Farm Bill was a step in the right direction, it wasn’t until the 2018 Farm Bill was passed that we saw hemp derivative products like Delta 9 hit the market.
The 2018 Farm Bill is what the current legality of hemp is based on. This bill legalized the production of hemp and removed it from the list of controlled substances. This bill also states that hemp is a covered agricultural commodity under crop insurance, which started the conversation around hemp policies. While this was a huge step for hemp growers, there are still some holdbacks. For example, hemp farmers have to make sure their crop contains under 0.3% THC per dry weight, and they must have an official license to grow. This is just one reason why products combining CBD and hemp-derive Delta 9 THC have become more popular.

CBD is the non-psychoactive compound in cannabis and is known for its versatile effects, which have been researched in anecdotal evidence and studies. Delta 9 THC can be derived from the hemp plant, which is legally defined as a cannabis plant that contains less than 0.3% of THC on a dry weight basis. Since they are technically the same species of plant, the only difference between cannabis and hemp is the THC concentration. Therefore, products with less hemp-derived Delta 9 THC than CBD typically, but not always, follow the law according to the 2018 Farm Bill by maintaining less than 0.3% of THC on a dry weight basis.

So what’s the difference between Delta 9 and other hemp derivatives like Delta 8 and Delta 10? Delta 9 THC is a naturally occurring form of THC extracted from hemp plants, but other derivatives such as Delta 8 and Delta 10 are synthesized from the extracts and altered to create different chemical compositions of tetrahydrocannabinol and maintain technical legality.
How Do You Know What’s Right For You?
First, make sure to do research on the brands and products you’re considering. Look for customer testimonials, third-party lab tests and the methods of processing and manufacturing.
